These Terms and Conditions ("Agreement") govern the use of the services provided by Fresh Luxury Transportation and Concierge Services ("we," "us," or "our"). By using our website, making a booking, or utilizing our transportation and concierge services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, you should not use our services.
1. Services Provided
Fresh Luxury Transportation and Concierge Services offers premium transportation, including but not limited to luxury sedans, SUVs, buses, and Sprinter vans, as well as concierge services for bookings, event planning, and travel arrangements. We reserve the right to modify, discontinue, or cancel any service at our discretion, subject to applicable laws.
2. Booking and Reservations
- Booking Process: To reserve our services, you must complete the booking process via our website or by contacting us directly. All bookings require payment details and confirmation of service details, including pick-up and drop-off locations, dates, times, and the type of vehicle required.
- Booking Confirmation: A reservation is considered confirmed only once you receive a confirmation email from us.
- Minimum Notice: We recommend booking services at least 24 hours in advance. Last-minute bookings will be considered based on availability.
- Cancellations and Changes: You may cancel or modify your reservation with at least 12 hours' notice. Cancellations made less than 12 hours before the scheduled pick-up time may incur a cancellation fee. Any modifications to your booking are subject to availability and may affect the final cost.
3. Payment and Pricing
- Pricing: All pricing for services will be provided at the time of booking, and will be based on the type of vehicle, duration of the service, distance traveled, and any additional services requested (e.g., concierge services).
- Payment: Full payment or a deposit may be required at the time of booking. We accept payment via credit cards, debit cards, and bank transfers.
- Additional Charges: Additional charges may apply for extra stops, extended wait times, or other special requests that go beyond the original scope of the service. Any additional fees will be discussed with the customer and agreed upon before service is provided.
4. Service Usage and Responsibilities
- Passenger Behavior: Passengers are expected to behave in a courteous and respectful manner. We reserve the right to refuse service to anyone who engages in abusive, threatening, or illegal behavior.
- Luggage and Personal Items: Passengers are responsible for ensuring their luggage and personal items fit within the vehicle's storage capacity. Fresh Luxury Transportation and Concierge Services is not responsible for lost, damaged, or stolen items.
- Consumption of Alcohol and Drugs: Consumption of alcohol or drugs in our vehicles is strictly prohibited unless expressly agreed upon for specific events or services where allowed by law. Passengers under the influence of alcohol or drugs may be denied service and will not be refunded.
- Smoking: Smoking is prohibited in all of our vehicles.
5. Chauffeur Conduct and Responsibilities
Our chauffeurs are professional and fully licensed. They are responsible for operating the vehicle safely and ensuring timely transportation to the agreed-upon destination. Chauffeurs are not permitted to engage in any activities outside the scope of the services provided, including, but not limited to, making personal stops or altering the route unless requested by the passenger.
6. Liability and Indemnification
- Limitation of Liability: While we strive to provide the highest level of service, Fresh Luxury Transportation and Concierge Services is not responsible for delays or damages arising from causes beyond our control, including but not limited to weather conditions, traffic, accidents, or other unforeseen events.
- Indemnification: You agree to indemnify and hold Fresh Luxury Transportation and Concierge Services harmless from any claims, damages, or losses arising from your use of our services, including any personal injury, property damage, or loss caused by your negligence, misconduct, or violation of these Terms and Conditions.
7. Privacy and Data Protection
Your privacy is important to us. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal information.
8. Force Majeure
We are not liable for any failure to perform our obligations under this Agreement due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, accidents, government actions, or any event that prevents us from providing the services agreed upon.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of The Commonwealth of The Bahamas. Any disputes arising from or related to these Terms and Conditions shall be resolved through mediation or in the courts of The Bahamas, as applicable. By using our services, you consent to the exclusive jurisdiction of these courts or the selected method of dispute resolution.
10. Modifications to Terms and Conditions
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the new Terms and Conditions.
11. Termination of Service
We reserve the right to terminate or suspend your access to our services at any time if we believe you have violated any provision of this Agreement, or for any other reason, without notice.
